Terms of Service

These Terms constitute a binding agreement between you and Busiman. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Services.

• You must have the capacity to contract under Indian law to use the Services. Where applicable, you must be at least 18 years old.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You agree to provide accurate information and to keep it updated.

Busiman provides business management software, including features such as inventory, multi-branch operations, user management, reporting, file uploads to cloud storage, and related tools. We may update or modify features over time.

• Subject to these Terms, Busiman grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes.
• You must comply with all applicable laws, including anti-spam, anti-bribery/anti-corruption, and export control laws.
• We reserve all rights not expressly granted.

• You retain ownership of your data. You grant Busiman a worldwide, non-exclusive license to host, store, process, and display your data solely to provide and improve the Services.
• You represent that you have obtained all permissions and rights necessary to submit and process your data via the Services.
• You are responsible for your content, including ensuring it does not infringe intellectual property or violate law.

• No reverse engineering or circumvention of security.
• No introduction of malware or disruption of networks.
• No unlawful, harmful, defamatory, or fraudulent activity.
• No unauthorized collection or processing of others’ data.
• No use that violates third-party rights or applicable law.

Certain features integrate third-party services (e.g., Google for sign-in, AWS for storage, payment gateways). Your use of such services is subject to their terms and privacy policies. We are not responsible for third-party products and services.

• Some Services or modules may be offered free of charge; if paid features are introduced, pricing and terms will be communicated prior to purchase.
• Payments, if any, will be processed by compliant payment partners. We do not store full card PAN, CVV, or UPI PIN.
• You are responsible for applicable taxes (including GST) and government levies arising from your use of paid Services.
• Invoices and payment records may be provided electronically.

You must use the Services in compliance with applicable Indian laws and regulations, including information technology, data-protection, consumer, and tax laws, as applicable to your operations.

Our processing of personal data is governed by our Privacy Policy. By using the Services, you acknowledge and agree to that policy.

• The Services, including software, interfaces, and content provided by Busiman, are protected by intellectual property laws. Except for rights expressly granted, no rights are transferred to you.
• You may not use our trademarks, logos, or branding without our prior written permission.

We may offer beta or trial features. These are provided "as is" without warranties and may be modified or discontinued at any time.

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, in no event will Busiman be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, or goodwill, arising out of or in connection with the Services. Our aggregate liability for all claims relating to the Services will not exceed the greater of INR 5,000 or the amount paid by you to Busiman for the Services in the twelve (12) months prior to the event giving rise to the claim.

You agree to indemnify and hold harmless Busiman and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Services or your breach of these Terms.

• These Terms remain in effect while you access or use the Services.
• We may suspend or terminate access immediately if we believe you have violated these Terms, law, or pose risk to the Services or other users.
• Upon termination, your right to access the Services ceases. We may retain and use data as permitted by law and our Privacy Policy.

These Terms are governed by the laws of India. You agree to the exclusive jurisdiction of competent courts/tribunals in India for any disputes arising out of or relating to these Terms or the Services, subject to applicable law.

We may update these Terms from time to time. We will post the updated Terms with a new effective date and, where required by law, provide notice or request consent to material changes. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
